Spring Photo Competition 2026 | Terms & Conditions
1. Promoter and acceptance
The Spring Photo Competition (Competition) is conducted by Funky Monkey Bars Pty Ltd, trading as Funky Monkey Bars, ABN 72 164 496 520, of 8/307 Stock Road, O'Connor Western Australia 6163 (Promoter).
Competition enquiries and privacy requests can be sent to info@funkymonkeybars.com.
By entering, entrants agree to these Terms and Conditions, including the permissions for publication and advertising in clause 10. These terms must be available to entrants before they submit an entry.
2. Eligibility
Entry is open to residents of Australia aged 18 years or older who submit an eligible photograph featuring genuine Funky Monkey Bars equipment. Children may appear in photographs but cannot enter in their own name.
Employees, directors and people directly involved in administering the Competition, and their immediate families, are not eligible. Immediate family means a spouse or partner, parent, child or sibling.
Entry is free. No new purchase is required. Entrants are responsible for their usual internet and data costs.
3. Competition dates
All times are Australian Western Standard Time (AWST, UTC+8), being Perth time.

Only entries received during the entry period and votes received during the voting period are eligible.
4. How to enter
To enter, upload a photograph(s) capturing springtime backyard fun with Funky Monkey Bars using the official entry form at [LINK]. Complete all required fields and consent confirmations, and submit your entry before the closing date (22/11/26).
Please upload the highest-quality original photographs available from your phone or camera. Avoid screenshots or copies downloaded from social media, as these may reduce image quality.
All entries must be submitted through the website form. Photos posted on Facebook or Instagram, shared in Stories, sent by direct message or tagged with @funkymonkeybars or a competition hashtag do not constitute an entry.
Entrants are welcome to share their photos on social media and tag @funkymonkeybars after entering via the official entry form. Social sharing is optional and does not provide additional entries or affect shortlisting.
Each different photograph counts as one entry. Multiple entries are permitted, but submitting the same photograph more than once does not create additional entries. Each entrant may have only one photograph shortlisted and may win only one prize.
There is no requirement to have a public social media account, share a post, tag friends or subscribe to marketing emails.
5. Photograph requirements and safe play
Entries must be genuine photographs featuring Funky Monkey Bars equipment and reflecting the theme of springtime backyard play.
Submit the highest-quality original image available. Clear, well-lit photographs without added text, borders, stickers or watermarks are preferred. Smartphone photographs are welcome; professional photography is not required.
Keep the original file. The Promoter may request it for verification, judging, publication or agreed advertising use and will allow at least five business days to respond.
Basic cropping, exposure and colour correction are permitted. AI-generated images, synthetic people, composites or edits that materially misrepresent the scene or equipment are not eligible.
Photographs must show safe, age-appropriate use consistent with the equipment's instructions and supervision requirements. Do not stage dangerous activities to obtain a photograph. Entries showing unsafe use, nudity, offensive material or unlawful conduct will not be accepted.
Avoid visible addresses, school identifiers or other unnecessary identifying details, particularly where children are shown.
6. Shortlisting
The Promoter's judging panel will select up to 15 finalist photographs, with no more than one photograph per entrant, using these equally weighted criteria:

Creativity and originality.

How well the photograph captures springtime backyard fun.

Composition, clarity and overall visual appeal.

How effectively it showcases safe, enjoyable use of Funky Monkey Bars.
Finalist photographs will be published at [LINK] for public voting, identified by an entry number and the entrant's first name and state/region.
The Promoter may reasonably request proof of eligibility, image ownership and the permissions required under clause 10 before publishing an entry. An entry that cannot be verified after a reasonable opportunity to respond may be excluded.
If fewer than three eligible entrants remain, only the corresponding available placings will be awarded.
7. Public voting and winner selection
Voting is free and open to Australian residents aged 18 years or older. Each person may cast one vote for one finalist during the entire voting period using a verified email address. Multiple email addresses do not entitle a person to additional votes.
Voters should choose the photograph they consider best meets the criteria in clause 6. Entrants may invite genuine votes and may vote for themselves.
The eligible finalists with the highest, second-highest and third-highest numbers of valid votes will receive first, second and third prize respectively. Social media likes, comments and shares do not count as votes.
Automated votes, purchased votes, duplicate votes, fabricated accounts and votes obtained through payments, gifts or other incentives are prohibited. The Promoter may remove votes where it has reasonable evidence of manipulation and may disqualify entrants who arrange or knowingly participate in it. Unsolicited activity by someone else will not, by itself, justify disqualifying an entrant.
If there is a tie, including a tie where no valid votes have been cast, the judging panel will compare the tied entries against the criteria in clause 6. If still tied, the panel will rank them first on creativity and originality, then on how well they capture springtime backyard fun. Any remaining tie will be resolved by a documented panel assessment of those criteria, without a random draw.
The Promoter will verify voting results before confirming winners. Selection decisions are final, subject to correction of a demonstrable error and entrants' rights under applicable law.
8. Prizes
Three Funky Monkey Bars gift cards are available:

The total prize pool is AUD $2,250. These are gift card prizes, not cash prizes.
Gift cards will be emailed within 7 days after the winner's eligibility and claim are verified. No payment is required to receive a prize.
Gift cards are valid for three years from issue and may be redeemed at www.funkymonkeybars.com. They may be used across multiple transactions until the balance is exhausted or the card expires. Any purchase exceeding the available balance must be paid for by the winner.
Gift cards cannot be redeemed for cash, except where required by law. Product availability and ordinary delivery limitations apply.
These Competition terms prevail if there is an inconsistency concerning a prize. No additional restriction will be introduced after entries open.
9. Winner notification and unclaimed prizes
Winners will be contacted within five business days after results are verified, through the official Funky Monkey Bars social account or the email address supplied with their entry.
Winners must respond within 14 calendar days of the first notification and provide information reasonably required to verify eligibility and deliver their prize. The Promoter will make reasonable further attempts to contact a non-responsive winner before reallocating a prize.
If a winner is ineligible, declines the prize or does not claim it within that period, the prize will be offered to the highest-ranked eligible finalist who has not already received a prize, using the voting results and tie procedure above. No random redraw will occur. Existing confirmed winners retain their placings.
Winning photographs and winners' first names and state, region or country may be announced on the Promoter's website, social media and competition emails. Children's names and entrants' residential addresses will not be published.
10. Image ownership, consent and advertising permission
Entrants retain copyright in their photographs. By entering, each entrant confirms that:

They own the copyright or have the copyright owner's express permission to submit the photograph and grant the licence below.

Every identifiable adult shown has given informed permission for entry, public display and the advertising uses described below.

For every identifiable child under 18 shown, the entrant is a parent or legal guardian authorised to give this permission, or has obtained that permission from an authorised parent or legal guardian. The child's own wishes must also be respected where they can understand the proposed use.

The photograph and its authorised use do not breach another person's rights or any applicable restriction.
By submitting an entry, the entrant grants the Promoter a non-exclusive, worldwide, royalty-free licence from the entry closing date to reproduce, publish and display the photograph to promote Funky Monkey Bars. This includes its website, organic social content, emails, digital and print campaigns, paid advertisements and boosted posts. This permission applies to all eligible entries, whether or not they are shortlisted or win.
The licence permits reasonable cropping, resizing, colour correction and the addition of branding or campaign text, provided the photograph is not used in a misleading, derogatory or inappropriate way. It does not permit synthetic alteration of a person's likeness or use to train generative AI models.
The entrant must have the photographer's consent to those specified edits and publication without a credit where a credit is impractical. No transfer of copyright or blanket waiver of moral rights is required.
The Promoter may allow its agencies, printers and platform providers to handle the photograph only as needed to carry out these uses on its behalf. No separate payment is due for authorised use.
Before using an entry in paid advertising, the Promoter will obtain a recorded confirmation of the relevant photographer and participant or guardian permissions. A social media tag alone will not be treated as proof that everyone pictured has consented.
A person pictured, or an authorised parent or guardian, can contact info@funkymonkeybars.com to withdraw consent for future promotional use. The Promoter will stop new use and remove content from channels it controls within a reasonable period, ordinarily 30 days. It cannot recall already distributed printed material or guarantee removal of independent third-party copies. This does not affect lawful past use or a prize already awarded.
If consent needed for public voting is withdrawn before results are finalised, the affected entry may need to be withdrawn. Declining further advertising use will not itself result in forfeiture of a prize.
11. Privacy
The Promoter collects entrants' contact details, photographs, permission records and, where reasonably needed, eligibility information to administer the Competition, verify consent, conduct voting, deliver prizes and carry out the authorised uses above.
Voting information is collected to verify and count votes and investigate suspected manipulation. It will not be displayed publicly.
Relevant information may be shared with service providers assisting with those purposes. Published images can be accessed worldwide. Details of relevant overseas service providers and likely destination countries are set out in our Privacy Policy here.
Information will be retained only as long as reasonably necessary for the stated purposes and applicable legal requirements. Entrants and voters can request access or correction, or raise a privacy complaint, through info@funkymonkeybars.com. Further information is available in our Privacy Policy here.
Entry or voting does not automatically subscribe a person to promotional emails. Any subscription must be a separate, optional choice.
12. Administration and liability
The Promoter may reject entries that breach these terms, are fraudulent or infringe another person's rights. It will act reasonably and allow clarification of an apparent error where practicable.
The Promoter is not responsible for an entry or vote that is not received because of circumstances outside its reasonable control. This does not exclude responsibility that cannot lawfully be excluded.
If a serious technical failure, fraud or event outside the Promoter's reasonable control prevents the Competition from being conducted fairly, the Promoter may take only steps permitted by applicable law, including any required regulatory approval. It will notify affected participants of a material disruption and protect valid entries and votes so far as reasonably possible.
The Promoter will not retrospectively change eligibility, selection criteria, prize values or image permissions to participants' disadvantage.
Nothing in these terms excludes, restricts or modifies rights or liabilities that cannot lawfully be excluded, including applicable Australian or New Zealand consumer protections. Participation does not waive those rights.
13. Facebook and Instagram
This Competition is not sponsored, endorsed, administered by or associated with Facebook, Instagram or Meta.
Information supplied for the Competition is provided to the Promoter, although use of a social platform remains subject to that platform's own terms and privacy practices.
To the extent permitted by law, entrants release Facebook and Instagram from claims arising from the administration of this Competition. This does not exclude any right or liability that cannot lawfully be excluded.
